Immer öfter werden der Natur eigene Rechte zugesprochen. Rund um den Globus helfen sie gefährdeten Ökosystemen, sich gegen schädliche Wirtschaftsinteressen zu verteidigen. Seit ihrer Einführung in die ecuadorianische Verfassung im Jahre 2008 wurden Rechte der Natur unter anderem in Bolivien, Kanada, Kolumbien, Neuseeland und den USA eingeführt. Zuletzt in Spanien zum Schutz einer Salzwasserlagune. Dieses Buch zeigt, wie die Idee der Rechte der Natur entstand, wie sie immer mehr an Fahrt aufnahm und wie sie uns künftig helfen kann, die Natur (...) und gefährdete Ökosysteme zu schützen. Dabei begibt es sich auf die Reise durch verschiedene Länder und Kontinente und stellt konkrete Anwendungsfälle und Initiativen vor. (shrink)

In this paper we attempt to identify which peer collaboration characteristics may be accountable for conceptual change through interaction. We focus on different socio‐cognitive aspects of the peer dialog and relate these with learning gains on the dyadic as well as the individual level. The scientific topic that was used for this study concerns natural selection, a topic for which students’ intuitive conceptions have been shown to be particularly robust. Learning tasks were designed according to the socio‐cognitive conflict instructional paradigm. (...) After receiving a short instructional intervention on natural selection, paired students were asked to collaboratively construct explanations for certain evolutionary phenomena while engaging in dialectical argumentation. Two quantitative coding schemes were developed, each with a different granularity. The first assessed discrete dialog moves that pertained to dialectical argumentation and to consensual explanation development. The second scheme characterized the dialog as a whole on a number of socio‐cognitive dimensions. Results from analyses on the dyadic as well as the individual level revealed that the engagement in dialectical argumentation predicted conceptual learning gains, whereas consensual explanation development did not. These findings open up new venues for research on the mechanisms of learning in and from peer collaboration. (shrink)

Drawing on the advances in the sciences and in the humanities, they address the question of how memory works, highlighting transactions between the interiority of subjective memory and the larger fields of public or collective memory.

Language has a rich typology of inferential types. It was recently shown that subjects are able to divide the informational content of new visual stimuli among the various slots of the inferential typology: when gestures or visual animations are used in lieu of specific words in a sentence, they can trigger the very same inferential types as language alone (Tieu et al., 2019 ). How general are the relevant triggering algorithms? We show that they extend to the auditory modality and (...) to music cognition. We tested whether pro-speech musical gestures, i.e. musical excerpts that replace words in sentences, can give rise to the same inferences. We show that it is possible to replicate the same typology of inferences using pro-speech music. Minimal and complex musical excerpts can behave just like language, gestures, and visual animations with respect to the logical behavior of their content when embedded in sentences. Specifically, we found that pro-speech music can generate scalar implicatures, presuppositions, supplements, and homogeneity inferences. (shrink)

Negligence, the creation of an unjustifiable risk of harm, plays a pivotal role in both criminal and civil law. This article takes up two negligence-related problems unique to its role in the criminal law. The first has to do with its "harm" component, the second with its "unjustifiability" component. The first problem is why the criminal law distinguishes so sharply between negligent wrongdoing that results in harm and negligent wrongdoing that does not, when it does not distinguish equally sharply between (...) intentional wrongdoing that results in harm and intentional wrongdoing that does not. The answer has to do with a peculiar feature in the logic of intention and with the symmetric way we ascribe responsibility for blameworthy and praiseworthy actions. My second problem is why the criminal law judges the blameworthiness of negligent actions on the basis of the harm wrought rather than the gap between the harm wrought and the justification for risking it. The answer has to do with a more general feature of the criminal law, the refusal to recognize "partial defenses" and "partial offenses.". (shrink)

The Securities and Exchange Commission (SEC) sanctioned investor-paid rating agency Egan-Jones for falsely stating that it did not know its clients’ investment positions. The SEC’s action against Egan-Jones raises the broad question whether knowledge of clients’ investment positions creates a conflict of interest for investor-paid ratings. In an experimental setting, we find that investor-paid rating agencies are likely to assign credit ratings that are biased in favor of their clients’ positions, and that this effect is attenuated when the rated company (...) has a sophisticated investor base that is expected to scrutinize ratings. The effect is not conditional on the risk profile of the rated companies. Taken together, our findings suggest that a conflict of interest stemming from investors’ preferences is likely to bias ratings under investor-pays business models, but scrutiny by the company’s investor base can counteract this bias. This paper reports an experimental investigation of presuppositions and scalar implicatures in language acquisition. Recent proposals posit the same mechanisms for generating both types of inferences, in contrast to the traditional view. We used a Covered Box picture selection task to compare the interpretations assigned by two groups of children and by adults, in response to sentences with presuppositions and ones with either ‘direct’ or ‘indirect’ scalar implicatures. The main finding was that the behavior of children and adults differed across (...) inference types. This asymmetry is consistent with the traditional perspective, but poses a challenge for the more recent uniform accounts. We discuss how the latter could be amended to account for these findings, and also relate the findings to previous results on presupposition processing. Finally, we discuss an unexpected difference found between direct and indirect scalar implicatures. (shrink)

This essay offers a critique of Larry Temkin’s seminal new book, Rethinking the Good, at the heart of which is the highly counterintuitive claim that all things considered judgments are not transitive. I evaluate Temkin’s claims through the lens of social choice theory, pursue some of its larger implications and applications, and conclude with a very general worry having to do with the intimate connection between transitivity and logical consistency, namely whether, if Temkin is right, this would not bring all (...) moral reasoning to an abrupt halt. The eukaryotic genome is a mosaic of eubacterial and archaeal genes in addition to those unique to itself. The mosaic may have arisen as the result of two prokaryotes merging their genomes, or from genes acquired from an endosymbiont of eubacterial origin. A third possibility is that the eukaryotic genome arose from successive events of lateral gene transfer over long periods of time. This theory does not exclude the endosymbiont, but questions whether it is necessary to explain the peculiar set (...) of eukaryotic genes. We use phylogenetic studies and reconstructions of ancestral first appearances of genes on the prokaryotic phylogeny to assess evidence for the lateral gene transfer scenario. We find that phylogenies advanced to support fusion can also arise from a succession of lateral gene transfer events. Our reconstructions of ancestral first appearances of genes reveal that the various genes that make up the eukaryotic mosaic arose at different times and in diverse lineages on the prokaryotic tree, and were not available in a single lineage. Successive events of lateral gene transfer can explain the unusual mosaic structure of the eukaryotic genome, with its content linked to the immediate adaptive value of the genes its acquired. Progress in understanding eukaryotes may come from identifying ancestral features such as the eukaryotic splicesome that could explain why this lineage invaded, or created, the eukaryotic niche. Contextualizing the emergence of history of philosophy within eighteenth-century German Enlightenment, this book discusses the philosophical nature of the historiographical concept ‘system of philosophy’ and the concept’s influence upon the methods of history of philosophy and history of ideas.

Metaphysics, formerly the queen of science, fell into oblivion under the onslaught of empiricism and positivism and its very possibllity came to be denied. Professor Elders traces the history of this process and shows how St. Thomas innovated in determining both the subject of metaphysics and the manner in which one enters this science, particularly in the framework of his Aristotle commentaries. The work then considers being and its properties, its divisions into being in act and being in potency, into (...) the act of being essence, and into substance and the accidents. Finally the causes of being are considered. The work also introduces and surveys the extensive literature of Thomas interpretation of the past 50 years. (shrink)

What are the objects of knowledge, belief, probability, apriority or analyticity? For at least some of these properties, it seems plausible that the objects are sentences, or sentence-like entities. However, results from mathematical logic indicate that sentential properties are subject to severe formal limitations. After surveying these results, I argue that they are more problematic than often assumed, that they can be avoided by taking the objects of the relevant property to be coarse-grained (“sets of worlds”) propositions, and that all (...) this has little to do with the choice between operators and predicates. This paper responds to two aspects of Ralph Johnson's Manifest Rationality (2000). The first is his critique of deductivism. The second is his failure to make room for some species of argument (e.g., visual and kisceral arguments) proposed by recent commentators. In the first case, Johnson holds that argumentation theorists have adopted a notion of argument which is too narrow. In the second, that they have adopted one which is too broad. Across the world, militaries are racing to acquire and develop new capabilities based on the latest in machine learning, neural networks, and artificial intelligence. In this paper, I argue that the shift into military AI is shaping human behaviour in heretofore unacknowledged and morally significant ways. Following Anders, I argue that as the human becomes digitally co-machinistic, they are compelled to adopt a logic of speed and optimisation in their ethical reasoning. The consequence of this is a form a moral (...) de-skilling, whereby military personnel working with digital infrastructures and interfaces become less able to act and decide as moral agents. This is an especially concerning development when it comes to the conduct of war, where the moral stakes could not be higher. (shrink)

Periodic tables (PTs) are the ‘ultimate paper tools’ of general and inorganic chemistry. There are three fields of open questions concerning the relation between PTs and physics: (i) the relation between the chemical facts and the concept of a periodic system (PS) of chemical elements (CEs) as represented by PTs; (ii) the internal structure of the PS; (iii)␣The relation between the PS and atomistic quantum chemistry. The main open questions refer to (i). The fuzziness of the concepts of chemical properties (...) and of chemical similarities of the CE and their compounds guarantees the autonomy of chemistry. We distinguish between CEs, Elemental Stuffs and Elemental Atoms. We comment on the basic properties of the basic elements. Concerning (ii), two sharp physical numbers (nuclear charge and number of valence electrons) and two coarse fuzzy ranges (ranges of energies and of spatial extensions of the atomic orbitals, AOs) characterize the atoms of the CEs and determine the two-dimensional structure of the PS. Concerning (iii), some relevant ‘facts’ about and from quantum chemistry are reviewed and compared with common ‘textbook facts’. What counts in chemistry is the whole set of nondiffuse orbitals in low-energy average configurations of chemically bonded atoms. Decisive for the periodicity are the energy gaps between the core and valence shells. Diffuse Rydberg orbitals and minute spin–orbit splittings are important in spectroscopy and for philosophers, but less so in chemical science and for the PS. (shrink)

Applied ontology is the attempt to put to use the rigorous tools of philosophical ontology in the development of category systems which can be of use in the formalization and systematization of knowledge of a given domain. In what follows we shall sketch some elements of the ontology of legal and socio-political institutions, paying attention especially to the normativity involved in such institutions. We shall see that there is more than one type of normativity, but that this fact that has (...) often been ignored in standard attempts by philosophers to build ontologies of legal and other socio-political entities. In order to provide a sound system of categories for legal and socio-political institutions and entities, however, the manifold of normativity needs to be addressed. The classical examples of normative statements have been moral propositions; they do not merely describe states of affairs; they tell us how states of affairs ought to be. The distinction between how things are and how they ought to be is the basis of the distinction between fact and value. Analytic philosophers for a long time shunned discussions of normativity and ethics. They considered ethical statements as pseudo-propositions, or as expressions of pro- or con-attitudes of no theoretical significance.1 Nowadays, in contrast, prominent analytic philosophers discuss normative problems and there are important books written by such philosophers on topics such as law and justice. Here we pay attention to three seminal thinkers in this development: H. L. A. Hart, John Rawls, and John R. Searle in concerning ourselves especially with the way in which they deal with the issue of normativity.
